Prenuptial settlement 27 December 1662

   Articles of Covenants p~mises grantes conditiones and Agreemts had made Concluded and Agreed upon the seaven and

Twentyeth daye of December in the yeare of our Lord god 1662; Betweene John Liverton of the p~ish of St Merryn in the

County of Cornewall yeoman of the first p~te, Henry Maye of the p~ish of St Evall in the said County of the second

p~te, Martin Liverton sone of the sayd John Liverton of the third p~te, and William Trevehan of St Merryn aforesayd

gent of the fowrth p~te, in Manner & forme followeing;

   Impr; The sayd John Liverton for and in Consideration of a Marriage shortly heereafter by gods p~mission to bee had

and solempnized by and betweene the sayd Martin Liverton and Jane Maye the daughter of the sayd Henry Maye; the sayd

John Liverton doeth Covenant and p~mise for himselfe his executors & Adminstrs to and with the sayd Martin Liverton

that hee the sayd John within the space of six weekes after the date heereof, will devise grante assigne & sett over,

unto the sayd Martin his executors Administrs & Assigns, All the right Tytle and Interest wch hee hath of and in a

certayne Tenemt with the appurtents called Trevethan wthin the p~ish of St Evall aforesayd, To have and to hould from

the 29th daye of September next, to him the sayd Martin his executors Administrs & Assigns in as large and ampell

Manner as the sayd John doeth or maye hould the same;

   2ly The sayd John doeth farther Covenant to and wth the abovesayd Henry Maye yt by good and sufficient Convayance

and assurance in the Lawe, hee will uppon reasonable notice & warneing to him given, Convaye and assure unto the sayd

Martin Liverton & his heires forever, all yt his Messuage or Tenemt with the Mills thereunto belonging, comonly called

or knowne by the name of Porthcothan in St.Merryn aforesayd, To have & to hould to him the sayd Martin & his heires

ymediately after the death of him the said John Liverton and Elizabeth his wife for ever; and farther yt if in case the

sayd Jane Maye shall Survive and after live the sayd John Liverton Elizabeth his wife and the sayd Martin (her Intended

husband) and shall have noe Issue of her body lawefully begotten by the sayd Martin, yt then the sayd Tenemt & Mill

called Porthcothan aforesayd shalbee chargeable wth one Anuelye or yearely rent to the sayd Jane for and Dureing the

terme of her natureall life of ffive Powndes;

   3ly The sayd Henry Maye for the Consideration aforesayd for p~misesse his executors and Administrs to paye the some

of Towe hundred & ffortey powndes of good & Lawfull money of England in Manner and forme followeing (vidzt) to paye

unto the sayd John Liverton ffiftey Powndes att or on the five & Twentyeth Daye of December next and other ffiftye

Powndes att or on the fower and Twentyeth daye of June the next followeing; And likewise doeth farther Covenant with

the sayd Martin to paye unto him in full of the sayd seavenscore Powndes ffortey Powndes being the risidewe att and on

the marriage daye of the sayd Martin with the sayd Jane.

   4ly And lastly the sayd Martin & William Trevethan doe Joyntly and severally Covenant for themselves theire exors &

Administrs and every and either of them that within the space of one Yeare after the date heereof, there shalbee a

Joynture made to and for the sayd Jane in the sayd Tenemt called Trevethan, or in some other place of the like value,

In witnesse whereof the p~tyes aforesayd to these p~sent Articles of Agreemt theire handes and Seales Interchangeably

   This indenture made the first daye of Januarye in the fouerteenth yeare of the raigne of most gratiouse Sovereigne

Lord Charles the second by the grace of god of England Scotland Ffrance and Ireland King defendor of the Ffayeth

Betweene John Leverton of the p~ish of St.Merryn in the Countye of Cornewall yeoman of the one p~te and Martyn Leverton

sone of the sayde John Leverton of the same p~ish and Countye of the other p~te witnesseth these p~sente that whereas

Ralph Bartley late of the p~ish of St.Evall in the Countye aforesayde husbandman beeing Lawefully possessed of an

Tenement with appurtanence thereunto belonging sett lyeing and beeing in the villiady and feilds of Trevethan within

the p~ish of St.Evall aforesayd, for and dureing the naturall life of one John Rilston the son of James Rilston late of

St.Breord deceased contayneing by estimation two farthings of Land or thereabouts bee itt more or less which was then

in the tenure and occupation of one John Evelyn, And the sayd Ralph being soe thereof possessed the Twentye sixth daye

of September in the sixth yeare of the raign of our late Soveraigne lord King Charles (1631) by his deed Indented for

the Consideration therein expressed, Did grante Devise Assign and sett over unto William Williams of the p~ish of

St.Merryn in the County aforesayd yeoman his Executors Administraters assignes, all the aforesayd tenement with the

appurtences there unto belonging togeather with all his deeds and convayances for the houlding the same To have and to

hould all and singuler the aforesayd p~misses with the appurtences unto the sayd William Williams his executors

Administators and Assignes from and ymediately after the ffeast of St.Michaell the archangell then next after the date

thereof for and dureing the full tyme and Terme of Three score yearse from thencefoarth next ensueing and fully to be

compleate and ended, if the sayd John Rilston should soe longe happen to live, amongest divers Articles Covenants and

Conditions in the said deed exprest whereunto relation beeing had doth and maye more playnely and att large appeard and

.......  whereas Sir Arthur Georges of Kewe in the county of Surrey Knight by his deed indented beareing date the

thirteenth daye of October in the sixteenth yeare of the raigne of our late Soveraigne Lord Charles (1641) by the grace

of god of England Scotland Ffrance and Ireland Kinge defender of the fayther for the consideration therein exprest did

grante devise Draft sett and .. ..... Lett, all and singuler the p~misses aforesayd with the appurtences togeather with

all houses Orchards Gardens Lands Meadows pastures Leases fordings moores heathes Comons Comons of pastures wayes

waters watering places easents p~fitts Comodityes and apputences to the sayd belonging being p~cell of the Mannor of

Pawton.  To Have And To Hould unto the sayd William Williames his executors administrators and assignes ymediatly from

and after the death surrender of forfyture or other determynation of the estate of the said Ralph Bartley of and in the

p~misses for and dureing the terme of ffower scoore and Nyneteen yeares from thence forth next ensueing and fully to

bee compleate and ended, if the sayd John Leverton, and Alexander Leverton sones of Hughe Leverton late of St.Evall or

either of them shall soe longe happen to live Yeilding and agreing therefore yearely after the Comencemt of the sayd

terme unto the sayd Sir Arthur George his heires and assignes the Anuall or yearely rent of Eight shillings of good and

lawfull money of England att the ffower most usuall ffeasts or termes of payment in the yeare (vidz) the ffeast of the

Birth of our Lord god the Anunciation of our blessed Lady Mary the virgin the Nativity of St John the Baptist and St

Michaell the Archangell, by even and equall portions to bee devided and payd, And after then yeilding and payeing

ffortey Shillings of Lawefull money of England for and in the name of a .... ..... ....... or ....... uppon and after

the deathes of or any of them the sayd John and Alexander, Provided allwayes that liveing the sayd John noe such sume

of money shall bee dewe or payd uppon the death of the sayd Alexander amongest divers other Articles Covenants

Conditions and Agreemts in the said deed exprest mentioned and contayned whereunto relation being likewise had doth and

maye more fully and att large appeare And whereas the sayd William Williames by his deed Indented beareing date the

fower and Twentyeth daye of June in the Nyneteenth year of the raigne of our said Soveraigne lord Kinge Charles (1643)

for the Consideration therein exprest did devise grante assign and sett over unto tha sayd John Leverton his executors

Administrators and assignes the aforesayd p~misses with the appurtenances in Trevethan aforesayd to have and to hould

unto him the sayd John Leverton his executors Administrators and assigns in as large and ampell manner as the sayd

William Williames his executors Administrators or Assignes might or ought to hould the same togeather with all deeds

and there Covenants and Assurances in the same as was unto the sayd William Williames granted or made As in and by the

sayd deed of Assignemt .. mentioned exprest and contayned amongest divers Articles Covenants and Agrements whereunto

relation beeing had will farther att large appeard nowe these presente witnesseth that the sayd John Leverton for and

in Consideration of a marriag allready agreed on and by gods p~mission shortly heereafter to bee had and solemnized

between the sayd Martyn Leverton and Jane Maye the daughter of Henry Maye of the p~ish of St.Evall aforesayd yeoman and

for theire better Libety and maynetaynanc and to the Intent there maye be a Joynture had and made for the said Jane

heereafter in the p~misses afore sayd, And in p~suance of Articles of Agreemt made bearinge date the seaven and

Twentyeth Daye of December Last touching and concerneing the sayd marriage, As alsoe for and in Consideration of the

naturall love and affection which the sayd John Leverton hath and beareth towards his sayd sone and for divers other

good causes and valluable Considerations him thereunto moveing Hath devised granted Assigned and Sett over and in and

by these p~sente, doeth fully clearely and absolutly devise grante assigne and sett over unto the sayd Martyn Leverton

his Executors Administs & Assignes, All and singular the aforementioned p~misses with the appurtenances, and every p~te

and p~cell thereof and all the right Tytle and Interest which hee the sayd John Leverton nowe hath or heereafter maye

have of in or unto the same by any way or meanes what soever To have and to hould all and singuler the p~misses

aforesayd with the appurtents in Trevethan aforesayd togeather with the sayd two severall originall Leases soe made by

the sayd Ralph Bartly and Sir Arthur Georges and the Assignemt Lease soe made by the sayd William Williames and all

other writeings, Charters, Scripts and mynuits which touch or concerne the sayd p~misses unto the sayd Martyn Leverton

his executors Administrs and Assignes from the Nine and Twentieth daye of September next for and dureing all the number

of yeares of the sayd severall Termes of yeares that are yett to count and expire of and in the p~misses if the sayd

Lives thereon, before mentioned or any or either of them shall soe longe happen to live And the sayd Martyn Leverton

doeth Covenant and p~mise for himself his executors & Administrs to yeild paye doe p~forme observe full fill and keepe,

all such Articles clauses Covenants Conditions and agreemts as the sayd John Leverton his executors Administrs or

assignes is or ought to doe for the p~misses aforesaid, by vertue of any of the afore mentioned deed or deeds or either

of them or by any other ways or meanes whatsoever, And the sayd John Leverton doeth Covenant and p~mise for himself his

executors Administrs and Assignes to and with the sayd Martyn Leverton his executors Administrs and Assignes, that the

p~misses are and soe shall continue from thence and disscharged of and from all manner of former or other bargaines

Sales Leases gifts grants charges and Incombrances whatsoever had made done suffered or comitted by him the sayd John

Leverton, And that the sayd Martyn shall and maye peaceably and quietly have hould occupy possesse and enioye the same

without the Lawefull lett molestation, Inturruption or denyall of him the sayd John Leverton or any other p~son or

p~sons whatsoever claymeing right Tytle or Interest in by from or under him. In witness whereof the p~tyes aforesayd to

 This indenture made the twenty third daye of january in the second year of the raigne of our soveraigne lord and lady

william and mary by the grace of god of england scotland france and ireland kinge and queene defenders of the faith xx

ammoq domini 1690 betweene martyn leverton of the parrish of st.merryn in the county of cornwall yeoman of the one

parte and henry leverton of the parrishe and county aforesaid yeoman of the other parte witneseth that the said martyn

leverton asweth for and in consideration of the sume of one hundred and fifty pounds of good and lawfull money of

england to him in hand paid by the said henry leverton att and before thensealing and delivery of these presents

whereof hee the said martyn leverton doth hereby acknowledge the receipt and thereof and every parte and parcell

thereof doth exonerate acquite release and discharge the said henry leverton his heirs executors administrators and

assigns and every of them in and by these presents; as for other good causes and considerations him thereunto

especially movinge hath granted bargained and solde devised leased assigned and departed with and in and by these

presents doth grante bargain and sell ...... lease assigne and departe with unto the said henry leverton his executors

administrators and assigns all that his messuage and tenement and one water=corne=mill and one little haye lyinge

the parrish of st.merryn and county of cornwall aforesaide and are commonly called and knowne by the name of

porthcothan also porthcothan=mill and all those messuages lands and tenements in or called by the name of trevithvan

situate and lyinge and beinge within the parrish of st.evall in the said county of cornwall togeather with all houses,

orchards, gardens, lands, meadowes, pastures, leasues, feedings, moores, wasts, comons, comonofpasture, wayes, waters,

wateringe=places, easements, profitts, commodityes, and appurtenances whatsoever to the same belonging or in any wise

apportaininge all which the said premisses are now in the actual possession of the said martyn leverton his assignee or

assignes to have and to hold all and singuler the said messuage, mill, lands, tenements, and other the premises with

the apputenances in or called porthcothan in the parish of st.  Merryn aforesaide unto him the said henry leverton his

executors administrators and assignes from the daye of the date hereof for and during the full time and terme of ninety

nine yeares if the said martyn leverton soe longe shall to live and to have and to holde the said messuges, lands,

tenements, and premises with the appurtenences in or called trevithvan in the parrish of st.evall aforesaide togeather

with all the right, title, interest, terme of yeares, claime, and demand of him the said martyn leverton of in and unto

the same unto him the said henry leverton his executors administrators and assignes from the day of the date hereof for

and duringe the full time and terme of seaventy yeares if the said martyn leverton for longe shall happen to live and

the estate of the said martyn leverton therein soe long shall happen to continue hee the said henry leverton from

henseforth yeildeinge and payeinge unto the said martyn leverton and his assignes for the said premisses in porthcothan

the sume of six shillings and eight=pence by quarterly payments that is to saye the feast of the anuntiation of our

blessed lady mary the virgin the nativity of st.john the babtist the feast of st.michaell the archangell and the

nativity of our lord god the same in over and equall portions to bee divided and paid duringe the said terme and alsoe

yeildeinge and payeinge, doinge, observinge, performinge fullfillinge, and keepeinge duringe the said terme of seveanty

yeares unto the lord or lords of the fee and fees of the said premises called trevithvan in the parish of st.evall

aforesaide all such rents suites and services as ought to be yeilded, paid, done, observed, performed, fullfilled, and

kept by the said martyn leverton for the same and the said martyn leverton for himselfe his heirs executors and

administrators doth in and by these presents covenant grant promise and agree to and with the said henry leverton his

executors administrators and assignes att all tymes thereafter ....quest to make any farther or other assurance or

assurances of the said premisses or any parte of them during the terme abovesaide and that it shall and may bee lawfull

to and for the said henry leverton his executors administrators and assignes from henceforth peaceably and quiettly to

have hold occupy possesse and enjoye the said respective premisses and every parte and parcell thereof with their

appurtenances duringe the respective termes aforesaide without the lawfull lett, denyall, hinderance, or molestacon of

any person or persons whatsoever freed, acquitted, exonerated and discharged or otherwise well and sufficiently saved

harmlesse and indempuifyed of and from all former and other gifts, grants, bargaines, sales, mortgages, whatsoever in
